Minutes of the last Meeting

Chairmans Report

Cllr Ford asked the Clerk to check a number of footpaths that

could need attention


Planning

PA25/03415. Ennys was discussed in full and it was

proposed by Cllr Howells and seconded by Cllr Behrens that

the Council recommends approval of this application, But with

a proviso that the ridge tiles should not go on the roof hips as

this should be be mortar thus keeping with tradition, All

Agreed.


Sunny B Appeal

It was proposed by Cllr Howells and seconded by Cllr Behrens

that we should contact Mr John Pender to help compile our

objections to this application, All Agreed.


Neighbourhood Plan Update

Cll Ryan circulated his report to all Councillors prior to this

meeting.


CIL Money.

It was decided that this will be held over to the next meeting.


Co-Option of new Councillor

There are four candidates for the two positions, Mr S Taylor,

Mr D Reed, Mr P Rule, Mr A Thomas,

Interviews will take place on the 18 th June, at 7pm with each

candidate getting 15 minutes.


Defibrillator

The Clerk was instructed to go ahead and purchase new pads

and re register the appliance.

CHAIRMANS REPORT

Cllr Ford  led a discussion about a proposed Solar farm at Trevarthian,Plain an Gwarry., After a full and varied discussion,  It was decided to ask Mrs Rachel Rhodda to help in compiling a landscape study, It was hoped that this meeting will take place on the 16th May at 7pm, It was also agreed to hold an open meeting in June to further discuss this item..

PLANNING

PA24/09239, This application was discussed but it was felt that more information was required before making a decision.

NEIGHBOURHOOD PLAN UPDATE

.


The need to protect former Miners’ Smallholdings as one of the seven key attributes conveying universal value to the World Heritage Site and therefore a heritage asset of the highest international importance proved crucial in preventing the affordable housing scheme proposed for the former strawberry field in Relubbus Lane.  The planning inspector’s decision at the appeal reflected similar previous decisions involving proposals to build housing on such sites.  We were therefore very disappointed to see the initial weak response of the WHS Management Office to the proposal to build stables for leisure horses on a former miner’s smallholding opposite Halamanning Chapel which included a plan to create a gateway through an existing field boundary (contrary to Policy 3 of our NDP) and an extensive gravelled area.  We also, on visiting the site, found that the applicants had already installed an extremely wide double gateway and extensive gravelling including a driveway lined with griselinea shrubs and not proper Cornish Hedging.


In our response to the Council we received considerable support from Roy King who provided historical evidence and argument supporting our case.  He also wrote to the WHS Management Team explaining what had happened and that we felt a firmer response was justified.  They replied as follows:


“Dear Mr King,


Thank you for your email. As you note, there is no in-principle objection on WHS grounds to the development of stables here and also the field itself has lost some of its integrity and authenticity through previous boundary loss.


The case officer for this application Diane Boardman has contacted me with photographs taken from her site visit showing the extent of the works, which provides more detail than shown on the plans.


Having reviewed the photographs she very kindly shared with me, I have advised her that in my opinion the width of the access track and double gate arrangement seems excessive. The gates are also very exposed as they have not been “bonded” to the boundary treatment. Typically, a five-bar gate would be mounted on granite or timber gate piers that are set within an established Cornish hedge that then forms the “shoulder” to the gate.


In addition, I have noted that the hedge returns as created, are not Cornish hedges and the top planting appears to be a single row of plantings. I have suggested a Cornish hedge with an appropriate planting schedule would be more suitable here.


Finally, I cannot be certain if the hardcore area shown in photographs matches the amount shown on the plans as there are no as-built measurements to compare to the plans. Irrespective of this possible discrepancy, I have advised that an alternative cellular grid paving system would likely be a better option as a finish as it could be seeded with grass for a greener finish here.


At the present time some harm has occurred to the field through the works as undertaken, although this would be regarded as less than substantial harm and would need to be considered and balanced by the LPA as part of the overall planning assessment relating to this proposed development. Equally, there is the potential to revise the works as undertaken to a more suitable scale and form, which again the LPA will also no doubt consider in assessing these proposals.

Once again this shows that Cornwall Council is not taking WHS protection sufficiently seriously and that we need to continue to raise awareness of the importance of the WHS and its protection amongst planning officers, councillors and the general public.

Councillor Martin reported that he attended the St Aubyns Estate presentation at St Pirans Hall, on the proposed solar farm site at Trevarthian farm . It was a well-designed  presentation and i became aware of a mixed response to the proposal, Again concerns were raised about the use of good agricultural land.

The members have received a letter from Cllr Ollie Monk , The portfolio holder for housing , Concerning  the results of the “call for land”. We were given a link  to a map which gives us the current land identified. We will be making all of the sites available to local councils for their comments  on factors such as deliverability for a period of six weeks . Following that period for comment, the sites will undergo suitability , availability and achievability assessment according to the  Governments technical criteria..

I will be on the Miscellaneous Licensing Committee, after a series of training sessions .This is due to another move from the CC administration. As a result , all the committee membership are shifted to accommodate the change.

I am now on West Sub Planning, Central Planning, The Budget Development Overview and Scrutiny Committee, The Economic Growth and Development Overview and Scrutiny Committee and Miscellaneous Licensing, As well as a substitute for East and Strategic Planning. Even during Purdah, West and Central Planning and Licensing committees continues to meet,

The Planning Committee members have a training session once a fortnight .Last week we had a presentation from the Planning Enforcement team, which was very interesting ,enlightening,but depressing

PUBLIC QUESTION TIME

Mrs Robinson asked the Council about the proposed Solar Panel Farm at Plain an Gwarry, She stated that most of the residents are against the plan, She outlined several issues concerning the farm and the site in question, Batteries are not efficient  and the land  is unusable for farming  after 40 years and this will provide a problem for future generations,                                                                                                 The Chairman then stated that as soon as the Parish Council has the planning application they will then make their decision.to put to the planning department.

PROPOSED SOLAR PANEL FARM

All Councillors gave their views on this item , And it was agreed that the Council canot make any decision until they have the plans before the Council, And then if needed they will call a public meeting.


NEIGHBOURHOOD PLAN UPDATE

Cllr Ryan reported that Cornwall Council had published a list on its website of only 11 NDPs out

of around 70 currently “made” that they believed would have additional protection under paragraph 14 of the NPPF.  These are views by the council as having met ALL of the following criteria

  1. The NDP is less than five years old and

  2. The NDP contains policies that seek to identify and address housing need in the neighbourhood area and

  3. The NDP has policies and/or site allocations that seek to address that need such as by leaving space for house building within development boundaries or where specific sites have been allocated for new homes.  Plans that have drawn development boundaries tightly around existing developed areas such as the St Hilary NDP would be unlikely to comply.

Provided a plan is viewed by Cornwall Council as having met all of these criteria it will continue to apply the housing policies in that NDP until it reaches five years old.  In all other NDPs, including that of St Hilary, housing policies, in particular development boundaries, will become out of date and will be afforded significantly less weight in planning decisions.  However, other than housing policies all other NDP and Local Plan policies will continue to have full weight in planning decisions.

We are advised not to attempt to amend our plan at this stage until Cornwall Council has managed to update its housing policies and is able to demonstrate a five-year land supply sufficient to meet its new significantly increased obligatory government set targets.  This will probably entail new increased targets for each parish which in the past we have comfortably exceeded through windfall development but may now have to make specific allocations of land on top of this when we come to revise our plan.

In the meantime, we are encouraged to make a Neighbourhood Priority Statement which will not contain policies or be a legal document but will need to be taken into account by Cornwall Council when it writes its revised plan.  These statements are meant to enable local people to influence the nature and scale of development they feel is needed for their area.  Currently there are 10 parishes or towns engaged in this as a pilot which the council intends to roll out across the county by June 2025.



CIL PAYMENTS

It was proposed by Cllr Vardy and seconded by Cllr Rule that the Council should go ahead and purchase a bench that will be situated beside the telephone box along Relubbus lane.All Agreed

The Clerk was asked to get a quote for a proposed path around the  open Churchyard.  Need update onthe proposed work to the memorial garden, Cllr Reed suggested that we could distribute |Owl boxes around the Parish, Cllr Vardy thought that some of the stiles within the Parish should be made disabled friendly,  Cllr Howells suggested that we put some money towards a project called Marazion Memories

CLLR  HOWELLS.  Reported that the bright lights at Tregonning hill are still causing concerns  CHT said that they are looking into the matter.

CLLR REED  Said that he recently attended  Cornwall council planning committee meeting but was not allowed to speak as he was not registered to speak.
